Warrant to Distrain

The Distress for rent rules 1988 allows a landlord or his agent to instruct certificated bailiffs to collect commercial rent arrears without the need for a court order.

With a Warrant to Distrain signed by the landlord / agent, our bailiffs are legally able to enter your commercial property to Distrain for unpaid rent. Our bailiffs will then speak to your tenant to attempt to resolve the problem as quickly as possible. We will seize and take an inventory of the Goods & Chattels belonging to the tenant as a measure to secure the debt. These items may be removed thereafter, in order to pay both rent arrears and other additional costs.

Notice will be served on the tenant, but if the landlord decides to allow the tenant more time to pay what is owed to you, the tenant will need to sign a Walking Possessions Notice. This confirms the extension of their payment schedule to you, allowing the goods to remain on the premises, albeit under legal possession of Chambers Recovery.

If payment is not received during the agreed timescale, action will then be taken to remove the Goods & Chattels seized, and sell them at public auction.

Forfeiture of Lease

A clause allowing forfeiture should be written into your tenancy agreement. This allows us to undertake the peaceful repossession of your commercial property, terminating the lease and returning the premises to you the landlord.

Chambers will always use a fully qualified locksmith to gain peaceful entry, locks will then be changed to ensure a complete transition and clear notices will be posted at all points of entry forbidding re-entry. An inventory and photographs will be taken.
